Protect Yourself: What You Need to Know About Tree Care Company Insurance

Many people are unaware that the tree care industry is one of the most dangerous professions out there. Tree care employees work at extreme heights (up to 120 feet here in the northeast) while using dangerous tools, such as chain saws. The danger is compounded by working near power lines, busy roadways and other infrastructure obstacles. These working conditions place urban tree work in the same category as logging, which is rated as the second most dangerous job in the USA and has a high risk of serious injury and/or death.

With all these risks in mind, you can see why having a company that’s properly insured should be at the top of your list. This is also why you should make sure that a tree care company has up-to-date industry certifications and licenses. This ensures that employees are properly trained and that they use the latest industry standards to mitigate the risks involved in tree care.

In most cases, consumers tend to lump tree care companies in with landscapers – after all, they both do “tree work,” right? But there’s a big difference – landscapers do not usually work in the high-risk situations listed above and are certainly not insured properly to cover these risks.

Two Types of Tree Care Companies

It’s important to understand how proper tree service will protect the health and safety of your trees, but it’s just as important to know how the tree care company is going to protect you from potential liability.

For this reason I generalize the tree companies into two categories:

  • “Tree Guys”
  • Arborists

“Tree Guys” will state or advertise that they are “Fully Insured” with liability and workers comp while not truly understanding what coverage is actually required. In most cases when we see “Fully Insured” advertised, it means nothing. There are only a very small number of tree companies in our area that have proper liability and workers compensation insurance.

Arborists work very closely with industry associations, such as the International Society of Arboriculture (ISA), Tree Care Industry Association (TCIA) and CT Tree Protective Association (CTPA), to stay at the forefront of the tree care industry while meeting or exceeding safety and tree care standards. Arborists are passionate about their industry and delivering a level of care and professionalism that greatly exceeds the “Tree Guy” scenario. Additionally, Arborists commit to a level of training, certifications and licensing that is ongoing and shows a commitment to being an industry steward that best represents consumers and their landscape needs.

About Insurance Policies for Tree Care Work

Insurance policies usually have a working height clause that for landscapers can be a maximum of 8 to 10 feet. So, in some cases, if they perform work in a tree above that height, the insurance policy is null and void.

This means that if a “Tree Guy” with a landscaping policy has an incident while working 40 feet up in tree, there might not be insurance coverage and you will be next in line for coverage.

About Workers Compensation

Workers compensation is legally required in Connecticut for companies with one or more employees (the owner isn’t required to have workers compensation, although it’s always a good idea to have it). It covers injuries that tree care company employees or owners suffer while at work. This is really the only protection you have from the liability of someone being injured while working on your property.

Without workers compensation, tree companies are legally required to take responsibility for work injuries. However, as the property owner you are next in line. If you hire a tree care company that has no workers compensation coverage, you will be required to pay the bill if an employee is injured and the company owner cannot pay. You can sue the company to recover damages, but you have to pay for the injured person’s medical bills, lost wages and costs associated with the injury in the meantime.

So if a contractor states that he has less than 5 employees and is not required to carry workers compensation, be aware that you are liable for coverage in the case of an incident on your property.

There is also the option for a company owner to opt out of workers compensation coverage. This could result in the same scenario above if the owner (or an employee) is injured on your property.

How to Protect Yourself

When requesting tree care quotes there are a few items to look for to ensure that you are covered in the event that something happens while the company is performing work on your property.

Certificate of Insurance

Request a Certificate of Insurance (COI) from the company. This should list their policy number and limits.

Example:

  • General Liability $1 million each occurrence and $2 million aggregate
  • Automobile Liability $1 million each accident
  • Umbrella Liability $1 million minimum
  • Workers Compensation $500,000 per accident

The contractor should also be able to add you as an additional insured or the certificate holder. The insurance company generally will do this for free. In some cases when doing work on a property line, both property owners should be listed.

Call the listed insurance company to confirm the policy is real and in good standing. Some ‘Tree Guys” have been known to produce fraudulent insurance certificates or use expired insurance certificates..

If a company takes offense to requesting this information. you probably shouldn’t be doing business with them.

Accreditation and Licensing

You can also look to see which companies are TCIA Accredited, which means that they have passed a rigorous industry audit to confirm they meet or exceed best practices for a tree care business. Part of this audit includes insurance requirements.

Search for Accredited tree companies in your area on the TCIA website.

Ask if the company has certified employees. These credentials can be validated at www.isa-arbor.com.

In Connecticut, most tree care work can only be done legally by licensed Arborists. Check the CTPA website to make sure the company is licensed.

References and Reviews

Reputable tree contractors should also have no problem providing references. Call them.

Lastly, engage the Internet. Check the BBB and social media for complaints and reviews. Some great sites are Yelp, Angies List, Google+ and YP.com.

With “Snowmageddon 2015” heading our way, we remind all home owners to stay safe – including when it comes to removing heavy snow loads from roofs and tree branches.

It’s difficult enough to shovel snow on a driveway or path. Add height and unstable, slippery surfaces to that, and you have a recipe for disaster.

Snow removal from a roof or tree should always be left to the professionals.

Safety is the number one consideration when shoveling snow off roof tops. We strap on our climbing gear before getting up on a roof and ensure that we’re properly tied in; that way, if anyone slips there’s no chance of falling off the roof.

While we’re up there, we’ll also remove ice dams that are backing up into your walls and windows from all the snow.

Don’t try this yourself! We only get up on your roof when we’re fully protected with all the necessary safety gear.

As for trees that are weighed down with snow or ice, don’t stand underneath and poke at the branches with a broom or shovel. All of that snow can easily cause the branch to snap and land right on top of you. You’d be surprised how many people do this! So leave it to the professionals if you’re worried that the snow load will damage the tree.

Insurance Considerations for Fallen Trees With Property Damage

Many homeowners who face the unfortunate occurrence of a tree that has fallen and damaged their property are frantic and unsure what to do.

Here are the typical questions asked in this situation:

  1. Should I call my homeowners insurance company? Is this covered by my insurance company?
  2. Is this my neighbor’s tree or my own?
  3. If my tree falls into my neighbor’s yard, am I responsible and liable for the damage?
  4. What about damage to my own property – am I covered?
  5. Is a local tree service available immediately to remove the large tree that fell on my house?
  6. How long will it take to fix the hole in my roof?
  7. Who is responsible for fixing the hole in my roof, and at whose expense?

These are all very good and common questions that arise during an emergency tree removal situation. In most cases, it is the insurance company that will be responsible for footing the bill for these expenses. Make sure your yard is safe from last years storms…Look up!

There is still an overwhelming amount of storm damage left from last year.

Yes the roads are clear and the big stuff is removed but there are still many trees that are partially uprooted, hanging limbs, cracked limbs, and trees that are greatly compromised from loosing limbs and trunks. Now that warm weather is upon us and BBQs will be starting up and kids playing in the yard make sure its a safe environment. Look around your yard for anything that might appear leaning and if the root ball has damage, usually there will be a mound on the upward side of the root ball. Look up and walk all the way around a tree and look for sagging branches, cracks, hanging limbs (widow makers) and if there are clusters of brown leaves that usually means thats a broken limb or branch.

We would strongly suggest having a professional come out to assess your trees which should be a free service from any reputable tree company. I have had hundreds of calls to come take down 1 or 2 hanging limbs and when we get there and walk around with the homeowner there are many things they did not see which were much more hazardous.

Tree Work Around Wires

When there is a tree removal or trimming of hazardous limbs that needs to be done in close proximity to electrical wires, there are a couple of things that can be done with CL&P to greatly reduce any risks and save money with the tree service since it saves them time while reducing risks. The best part is these services are free from CL&P since it’s much more economical to be proactive versus coming out to an emergency call to repair downed wires.

Two Types of Electrical Wires

There are two electrical wire scenarios to consider; service wires and high wires. They can both kill you but the high wire will kill you faster since its carrying much higher voltage.

High Wires

The high wires are generally the wires at the top of the telephone pole and some are shielded but I have been told if you provide a ground it will blow right through the shielding so I’ll take their word on that.

Service Wires

The second scenario is the service wire which is the wire that connects your house to the utility pole. These electrical wires are insulated for leaf and occasional branch contact. Note they will still electrocute you if there is any crack in this insulation so do not go near them!

Utilities Only Trim Trees Around High Wires

So now that you know the two types of wires out there you will understand why CL&P will trim trees around the extremely dangerous high wires but will not trim around service wires to your house. Tree trimming around service wires is the responsibility of the property owner. But, given the danger of these wires, don’t ever try to do this yourself. This is where you hire a professional tree service (like Barts Tree Service) who will coordinate removing/protecting the wires and removing the tree hazards.

Since there are two sets of wires, there are two separate departments that handle them at CL&P. One department will remove service wires from the house and the other department will cover and protect high wires.

Process for Covering High Wires

If both high wire covering and line removal are required, I always do this first since it takes longer to schedule and the covering will stay up until I call to have it removed.

  1. Call CL&P to have a line crew cover wires (call 800-286-2000)
  2. Provide the service address
  3. Provide a cross street
  4. Provide the pole number
  5. Provide a description of the work to be completed (for example, remove oak tree located next to pole)
  6. They can cover the wires and they can cover the insulators on top of the pole so be specific about what needs to be covered.
  7. CL&P will provide you with a Line Crew Request Number and date or date range for when work will be conducted.
  8. Once the tree work is complete, call CL&P Line Crew back at 800-286-2000,  give them the request number, and tell them the line covering can be removed.

Process for Removing Service Wires From Your House

  1. Call CL&P Line Removal Desk (call 888-544-4826)
  2. Supply CL&P with property owner’s name and address
  3. Supply affected pole number
  4. Supply closest cross street
  5. CL&P will provide the available dates for line removal (generally a week or two out)
  6. CL&P will assign a request number
  7. If we (Barts) are setting this up for the client, I request the home owner fax a letter to CL&P that contains the following; date, request number, name, address, “I am aware the power will be disconnected from my house on date and reconnected later that afternoon to allow for tree work to be conducted”. Then sign and fax to 877-285-4448. Note that if there are multiple lines to be removed from separate homes, each home owner needs to send the fax letter.
  8. CL&P will show up between 8-9AM to remove the wires from the house and someone must be there to meet them.
  9. CL&P will return to reinstall wires between 1-2 PM unless they are called a couple hours prior to push out the time later in the day.

Identifying and Removing Hazardous Trees in Connecticut

Trees are essential to our world, offering a wide range of benefits to our environment. However, trees become hazardous liabilities if they fall and injure people or damage property. Proper constant maintenance will help prevent and identify when a tree becomes dangerous.

What to Look For

High-risk defects are signs that a tree is failing. Look for seven important tree defects: dead wood, cracks, weak branch unions, decay, cankers, root problems, and poor tree form. These tree defects will be described in the next several sections.

Remember: a tree with defects is not hazardous unless some portion of it is within striking distance of a target.

#1 – Dead Wood

Dead trees and branches are unpredictable and can break and fall at any time. Dead wood is often dry and brittle and cannot bend in the wind like a living tree or branch. A dead branch and treetop that is already broken off (a “hanger” or “widow maker”) is especially dangerous.

Act immediately if . . .
• A broken branch or treetop is lodged in a tree.
• A tree is dead.
• A branch is dead and of sufficient size to cause injury. Typically this is a branch larger than 4 inches in diameter, but this can vary with branch height. Even smaller branches, falling from high in the tree, can cause serious personal injury.

#2 – Cracks

A crack is a deep split through the bark, extending into the wood of the tree. Cracks are extremely dangerous because they indicate that the tree is already failing.

Act immediately if . . .
• A crack extends deeply into, or completely through the stem.
• Two or more cracks occur in the same general area of the stem.
• A crack is in contact with another defect.
• A branch of sufficient size to cause injury is cracked (typically larger than 4 inches in diameter).

#3 – Weak Branch Unions

Weak branch unions are places where branches are not strongly attached to the tree. A weak union occurs when two or more branches grow so closely together that bark grows between the branches and inside the union. This ingrown bark, called “Included bark” does not have the structural strength of wood and the union can become very weak. The inside bark may also act as a wedge and force the branch union to split apart. Trees with a tendency to form upright branches, such as elm and maple, often produce weak branch unions.

Act immediately if . . .
• A weak branch union occurs on the main stem.
• A weak branch union is associated with a crack, cavity, or other defect.

#4 – Decay

Decaying trees are prone to failure, but the presence of decay alone does not necessarily mean failure. Still, advanced decay (soft, crumbly wood with a cavity) is serious. Evidence of fungal activity including mushrooms and conks are indicators of advanced decay. Decay is very common on the majority of large maple trees we have in Connecticut because of their large size and structure. A tree usually decays from the inside out, forming a cavity, but sound wood is added to the outside of the tree as it grows. Trees with sound outer wood shells are relatively safe. Still, evaluating the safety of a decaying tree is usually best left to trained arborists.

Act immediately if . . .
• Advanced decay is associated with cracks, weak branch unions, or other defects.
• A large branch is decayed.
• The thickness of sound wood is less than 1 inch for every 6 inches of diameter, at any point on the stem.

#5 – Canker

A canker is a localized area on a stem or branch of a tree, where bark is sunken or missing. Cankers are caused by wounding or disease. The presence of a large canker increases the chance of the stem or branch breaking near the canker.

Act immediately if…
• A canker affects more than half of the tree’s circumference.
• A canker is physically connected to a crack, weak branch union or cavity.

#6 – Roots

Trees with root problems may blow over in windstorms or even fall from the weight of the tree’s leaves in summer. Root problems can be caused by severing or paving-over roots; raising or lowering the soil depth over roots; traffic over the roots; or root decay. Dieback, dead wood in the crown and off-color or smaller than normal leaves are symptoms associated with root problems. These above ground symptoms may serve as your best warning.

Act immediately if. . .
• A tree is leaning with recent root exposure, soil movement, or soil mounding near the base of the tree.
• More than half of the roots under the tree’s crown have been cut or crushed.
• Advanced decay is present in the root flares or buttress roots.

#7 – Poor Tree Form

Trees with strange shapes are interesting to look at, but may be structurally defective. Poor tree form often results from many years of damage from storms, unusual growing conditions, improper pruning, topping, and other damage.

Act immediately if . . .
• A tree leans excessively.
• A large branch is out of proportion with the rest of the crown.

Finding multiple defects in a tree should be your red flag when evaluating its potential to fail. Multiple defects that are touching or are close to one another should be carefully examined. If more than one serious defect occurs on the tree’s main stem, you should assume that the tree poses a very high level of risk and corrective actions should be taken.

If a high-risk situation exists, there are four recommended options for correcting the problem:

  • move the target
  • prune the tree
  • convert the tree to a wildlife tree or
  • remove the tree

Moving the target is often an inexpensive, effective, and simple treatment for correcting a high-risk tree. Easily moved items like play sets and swings, vehicles, and picnic tables can be placed out of the reach of the hazardous tree with little effort and expense. If the target cannot be moved and a high-risk situation exists, consider blocking access to the target area until the hazard can be eliminated.

Consider Corrective Action

Practicing proper tree pruning is excellent preventive medicine!
A defective branch or branches may cause a high-risk situation, even though the rest of the tree is sound. In this case, pruning the branch or branches solves the problem. Practicing proper tree pruning is excellent “preventive medicine” for reducing the occurrence of defective, high-risk trees. By pruning properly, early in a tree’s life, you can prevent or correct many of the problems that cause trees to fail as they mature. Improper pruning techniques can worsen the problem, and may ultimately result in the formation of cracks, decay, cankers, or poor tree architecture that lead to very high risk situations. Creating Wildlife Habitat

This corrective action is often overlooked. Corrective actions should be selected with safety in mind while preserving a portion of the tree intact to provide wildlife habitat. One option is to reduce the height of a tree to the point that it would no longer strike a target if it should fail. Remove major branches that are defective, and leaving a portion of the tree intact for wildlife habitat. If a tree must be removed for safety reasons, consider leaving the tree on ground to create wildlife habitat.

Remove the Tree

Before removing a tree, carefully consider whether the effects of removing the tree could result in reduced property values. Tree removal should be considered as the final option and used only when the other corrective actions will not work. Tree removal is inherently dangerous and is even more serious when homes and other targets are involved. Removal of very high-risk trees is usually a job for a professional.

Cabling and Bracing

Cabling and bracing do not eliminate all the safety risks associated with a highly defective tree, but when done correctly by a trained arborist, it can extend the time a tree or its parts are safe. Done incorrectly, it creates a more serious hazard. Cabling or bracing is not recommended for a high-risk tree unless the tree has significant historic or landscape value, the cabling or bracing is done by a trained professional, is regularly inspected, and properly maintained.

Conclusion

Evaluating and treating tree hazards can be a complicated process, requiring a certain level of knowledge and expertise. I have outlined some of the basic problems that may alert you to a hazardous situation, and suggest some possible ways to correct them.

A professional should be consulted when undertaking many of the suggested corrective actions. When in doubt about how much risk a defective tree poses, or how to best treat it, consult with a professional like Barts Tree Service.

Remember that trees do not live forever. Design and follow a backyard landscape plan that includes proper tree selection and a cycle of tree maintenance and replacement. This is the best way to preserve the health of your trees and ensure a safe and enjoyable outdoor experience.

Did An Excellent Job

I first used Bart's Tree service in 2013 to take down a large catalpa that was splitting at the base. Matt understood our concerns about the septic and his team carefully took down the tree without having any of the trunks go near the septic. Very Professional!

Barts tree service removed two trees and trimmed another very large tree near power lines at a reasonable price. They were quick responding when we had questions and provided proof of all licensing required. Barts arrived when they said they would and left the property in very good condition despite a difficult property to maneuver on.

Pleasant and Efficient

We first met Matt, the owner, during Hurricane Irene. A huge pine fell on our house and our neighbor recommended Barts. Hurricane Sandy Clean-Up

Great Stump Grinding Job

I happened to see a sign for Bart's Tree Service stump grinding. I called and got a call back and a visit for an estimate THE SAME DAY.
